Dental practice and dentist malpractice insurance in West Virginia
Dental Practice Insurance Group provides dental practice and dentist malpractice insurance in West Virginia. For West Virginia practices, our licensed team shops the malpractice market and pairs it with office property, cyber, workers' comp and employment practices coverage.
West Virginia caps non-economic damages in malpractice cases, but the cap only protects a provider carrying at least $1 million per occurrence of coverage. That one condition turns the limit on your dental malpractice insurance into part of your legal position, for practices in Charleston, Morgantown and across the state, and it shapes how the rest of your dental practice insurance is set.

West Virginia's cap comes with a $1 million condition
In West Virginia, whether a damages cap protects you depends on the limit you buy. The Medical Professional Liability Act caps non-economic damages, but W. Va. Code 55-7B-8(d) says the caps aren't available to any defendant without medical professional liability insurance "in the aggregate amount of at least $1 million for each occurrence" covering the injury in question. Dentists are named as health care providers in the Act, so a dentist with lower limits, or no policy, can face uncapped non-economic damages.
The cap amounts
The base caps are $250,000 per occurrence, or $500,000 per occurrence for wrongful death, a permanent and substantial deformity, loss of use of a limb or bodily organ system, or a permanent injury that prevents independent self-care. They apply regardless of how many plaintiffs or defendants are involved. Since January 1, 2004 they've been adjusted each year for inflation, but never above 150% of the base, which works out to $375,000 and $750,000. We found no official figure for 2026, so confirm the current amount with an attorney. Economic damages aren't capped.
Two years, with a 10-year outer limit
Under 55-7B-4, a claim is due within two years of the injury or two years from when it was or should have been discovered, whichever is later, but never more than 10 years after the injury. A child injured before age 10 has two years or until the 12th birthday, whichever is longer, and the clock stops while a provider conceals or misrepresents material facts.
Notice of claim and the screening certificate
At least 30 days before filing, the patient must serve each provider by certified mail with a notice of claim setting out the theories of liability and listing every provider being noticed. It comes with a screening certificate of merit, signed under oath by a qualified health care provider, stating the standard of care, how it was breached, how that caused the injury and which records were reviewed. We found no patient compensation fund in West Virginia and no statute requiring dentists to carry malpractice coverage.
Choosing limits with the cap in mind
- $1 million per occurrence is the line. Below it, the cap may not apply to you. Carrying $1 million per claim with a $3 million aggregate clears it.
- Tail for a 10-year window. Discovery claims can arrive up to a decade after treatment, so plan tail or prior-acts coverage before you sell, retire or switch.
- Consent to settle. Payments are reported to the National Practitioner Data Bank and the state board.
This page explains the law in general terms; a West Virginia attorney can apply it to your situation. Our claims-made vs occurrence guide explains tail.
The West Virginia Board of Dentistry
Dentists report CE and renew on a two-year cycle with the West Virginia Board of Dentistry under legislative rule 5-11. In 2025 the Legislature amended the rule (SB 369), striking the required block of drug diversion, controlled-substance prescribing and opioid antagonist training and putting at least 2 hours of infection control training in its place. Check the Board for the current total hours.
The Board must investigate any written complaint, and it can open one on its own from credible information or from the Board of Pharmacy's quarterly controlled-substance reports. In its FY2024-2025 biennial report, most logged complaints alleged a standard-of-care problem; most closed with no action, and some ended in consent agreements. See board complaint coverage.
West Virginia workers' comp for dental offices
Any employer regularly employing another person needs comp, so one regular employee is enough. Owners have choices: the practice may elect to leave out a sole proprietor, partners, or a corporation's directors and its president, vice president, secretary and treasurer, even when those officers also work chairside. Other officers or assistant officers who also do employee work can't be excluded on that basis. A dental PLLC may leave as many as four of its managers, officers or members off the policy. An uninsured employer can be sued by an injured worker for damages without the usual common-law defenses, and unpaid premiums, interest and penalties become a personal obligation and a lien against the employer's property. Expect NCCI class 8832 (physician and clerical) for a typical dental office, subject to your carrier's classification. See workers' comp for dental practices.
West Virginia breach notice and HIPAA
W. Va. Code 46A-2A-102 requires notice without unreasonable delay when a breach causes, or is reasonably believed to cause, identity theft or fraud. There's no Attorney General notice requirement, but the consumer reporting agencies must be told if more than 1,000 people are notified. The Attorney General enforces the law and can seek civil penalties, only for repeated and willful violations, of up to $150,000 per breach.
The statute has no HIPAA-specific clause, but an entity that notifies under its primary or functional regulator's procedures is deemed compliant. For patient records, HIPAA requires notice without unreasonable delay and within 60 days of discovery. Your attorney can confirm how the two fit. See cyber insurance for dental offices.

Risks West Virginia practice owners face
Flash flooding
The June 23, 2016 floods dropped 8 to 10 inches of rain in under 12 hours in parts of Greenbrier County, damaged or destroyed thousands of homes and businesses, killed 23 people and caused an estimated $1.2 billion in damage. The Elk River rose more than 28 feet at Clay and Queen Shoals, upstream of Charleston.
Complaints that start from prescribing data
The Board doesn't have to wait for a patient. It can open a complaint from the Board of Pharmacy's quarterly controlled-substance reports.
Limits below $1 million
Choosing a lower malpractice limit to save premium can cost the protection of the cap.
West Virginia cities where we insure dental practices
Morgantown
WVU School of Dentistry runs general practice, oral and maxillofacial surgery and the state's only pediatric dentistry residency. Monongalia County has 146 actively practicing dentists, more than any other county, and the school's residencies feed the region's specialty practices.
Charleston
Kanawha County has 134 actively practicing dentists. The 2016 floods killed six people in the county, a reminder that closed roads can stop production even when the office is dry, the situation business income coverage addresses.
Huntington
Cabell County has 57 actively practicing dentists, behind only Monongalia, Kanawha and Berkeley, which makes Huntington a practical market for buying into established solo practices.
Parkersburg
Wood County has 39 actively practicing dentists while neighboring Wirt County has none, so Parkersburg offices draw patients from a wide rural area. That reach matters when you value or buy a practice in the region.
